Welcome to EVLV. These Terms of Service (“Terms”) govern your access to and use of the EVLV mobile application, website, products, services, content, features, and related tools collectively referred to as the “Service.”

By creating an account, accessing EVLV, or using the Service, you agree to these Terms. If you do not agree, do not use EVLV.

EVLV is a fitness, nutrition, supplementation, recovery, mindset, and self-improvement platform designed to help users track habits, generate plans, review progress, and receive personalized guidance through app features and AI-assisted tools.

You must be at least 13 years old to use EVLV.

If you are under the age of majority in your province, state, or country, you may only use EVLV with permission from a parent or legal guardian.

By using EVLV, you confirm that you are legally allowed to use the Service and agree to these Terms.

EVLV is provided for general fitness, wellness, educational, and informational purposes only.

EVLV does not provide medical advice, diagnosis, treatment, or emergency services. The information, plans, recommendations, insights, supplement suggestions, recovery guidance, or AI-generated responses provided through EVLV are not a substitute for advice from a qualified doctor, dietitian, pharmacist, trainer, therapist, or other licensed professional.

You are responsible for deciding whether any activity, exercise, nutrition plan, supplement, recovery method, or wellness practice is appropriate for you.

Before starting or changing any exercise, nutrition, supplement, recovery, or wellness program, you should consult a qualified professional, especially if you have a medical condition, injury, are taking medication, are pregnant, or have specific health concerns.

Stop any activity immediately and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, fainting, allergic reaction, or any other concerning symptoms.

EVLV may provide training plans, meal suggestions, nutrition targets, supplement routines, recovery protocols, habit recommendations, or performance insights.

You understand and agree that:

• Exercise carries risk of injury.
• Nutrition and supplement needs vary by person.
• Supplements may interact with medications or health conditions.
• AI-generated guidance may be incomplete, inaccurate, or inappropriate for your specific situation.
• You are responsible for using judgment and seeking professional advice when needed.

EVLV does not guarantee any specific result, including weight loss, muscle gain, improved performance, improved health, increased testosterone, better sleep, or any other outcome.

EVLV may use artificial intelligence features, including EVO, to generate plans, insights, summaries, recommendations, explanations, or responses.

AI-generated content may not always be accurate, complete, current, or suitable for your individual needs. You should review all AI-generated guidance carefully before relying on it.

You agree not to treat AI-generated content as medical, legal, financial, emergency, or professional advice.

EVLV may update, modify, limit, or remove AI features at any time.

You may need to create an account to use certain EVLV features.

You agree to:

• Provide accurate account information.
• Keep your login credentials secure.
• Notify us if you believe your account has been accessed without permission.
• Accept responsibility for activity that occurs under your account.

EVLV is not responsible for losses caused by your failure to protect your account credentials.

We may suspend or terminate accounts that violate these Terms, misuse the Service, create risk for EVLV or other users, or are required to be restricted by law.

The Privacy Policy explains what information we collect, how we use it, how it may be shared, how it is protected, and what choices you may have.

By using EVLV, you acknowledge that you have read and understood the Privacy Policy.

You may enter, upload, generate, or store information in EVLV, including profile details, fitness goals, workouts, nutrition logs, supplement routines, check-ins, photos, notes, preferences, and other content (“User Content”).

You retain ownership of your User Content.

You grant EVLV a limited license to use your User Content only as needed to operate, provide, improve, secure, personalize, and support the Service.

You agree that you will not submit content that is unlawful, harmful, abusive, misleading, infringing, or violates the rights of others.

EVLV may store certain information locally on your device and may sync or back up data to your account when connected.

We work to protect and preserve your data, but we cannot guarantee that data will never be lost, corrupted, delayed, unavailable, or affected by device issues, network problems, service outages, software errors, or user actions.

You are responsible for maintaining any separate records or backups you consider important.

EVLV may offer free and paid features, subscriptions, trials, or premium plans.

If you purchase a subscription through the Apple App Store, Google Play Store, or another third-party platform, your purchase is handled by that platform and may be subject to its terms, billing rules, cancellation process, and refund policies.

Subscriptions may automatically renew unless cancelled according to the platform’s rules. Apple states that auto-renewable subscriptions renew automatically unless cancelled by the user, with subscription duration and price configured in App Store Connect.

EVLV does not control third-party billing platforms and may not be able to issue refunds for purchases processed by them.

We may change pricing, features, plan names, or subscription offerings at any time, subject to applicable law and platform rules.

You agree not to:

• Use EVLV for unlawful, harmful, abusive, or fraudulent purposes.
• Attempt to hack, disrupt, reverse engineer, scrape, overload, or interfere with EVLV.
• Use EVLV to generate or distribute harmful, unsafe, misleading, or illegal content.
• Misrepresent your identity or impersonate another person.
• Use EVLV in a way that could harm EVLV, other users, third-party services, or app platforms.
• Copy, resell, sublicense, or commercially exploit EVLV without permission.
• Attempt to bypass access controls, subscription restrictions, or security protections.

EVLV, including its app design, branding, logo, name, software, features, text, graphics, interface, workflows, AI prompts, systems, and content, is owned by EVLV or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from EVLV unless we give written permission or the law allows it.

You may use EVLV only for your personal, non-commercial use unless we agree otherwise in writing.

EVLV may integrate with or rely on third-party services, including authentication providers, cloud hosting, analytics, AI providers, app stores, payment processors, nutrition databases, wearable platforms, or other tools.

We are not responsible for third-party services, websites, platforms, data, content, policies, or practices.

Your use of third-party services may be governed by their own terms and privacy policies.

If you download EVLV through the Apple App Store, Google Play Store, or another app marketplace, your use of EVLV may also be subject to that platform’s terms.

For Apple users, Apple’s standard Licensed Application End User License Agreement may apply unless EVLV provides a separate custom license. Apple’s standard terms govern licensed apps and related content or services accessed through the app unless a custom EULA applies.

We may update, modify, suspend, limit, discontinue, or remove any part of EVLV at any time.

We may release new features, change existing features, fix bugs, change layouts, update AI behavior, or adjust how plans and insights are generated.

We do not guarantee that EVLV will always be available, uninterrupted, error-free, secure, or compatible with every device or operating system.

EVLV is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, merchantability, non-infringement, availability, security, and performance.

We do not guarantee that:

• EVLV will meet your expectations.
• Plans or recommendations will produce specific results.
• AI-generated content will be accurate or appropriate.
• Data will always sync or remain available.
• The Service will be uninterrupted or error-free.
• Any fitness, nutrition, supplement, recovery, or mindset outcome will occur.

To the fullest extent permitted by law, EVLV and its owners, employees, contractors, affiliates, partners, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, personal injury, health outcomes, business interruption, loss of goodwill, or other losses arising from or related to your use of EVLV.

To the fullest extent permitted by law, EVLV’s total liability for any claim related to the Service will not exceed the greater of:

(a) the amount you paid to EVLV for the Service in the 12 months before the claim, or
(b) CAD $100.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

You agree to defend, indemnify, and hold harmless EVLV and its owners, employees, contractors, affiliates, partners, licensors, and service providers from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:

• Your use or misuse of EVLV.
• Your violation of these Terms.
• Your User Content.
• Your violation of any law or third-party right.
• Any action you take based on EVLV content, recommendations, or AI-generated guidance.

You may stop using EVLV at any time.

We may suspend, restrict, or terminate your access to EVLV if:

• You violate these Terms.
• Your use creates legal, security, operational, or reputational risk.
• We are required to do so by law.
• We discontinue the Service.

After termination, some provisions of these Terms will continue to apply, including sections related to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

You may request deletion of your account through the app if available or by contacting us at:

Deletion may permanently remove account information and associated data, subject to legal, security, fraud prevention, backup, or legitimate business retention requirements.

Some information may remain in backups or records for a limited time where permitted or required by law.

We may update these Terms from time to time.

If changes are material, we may provide notice through the app, website, email, or other reasonable methods.

Your continued use of EVLV after updated Terms take effect means you accept the updated Terms.

The “Last Updated” date above shows when these Terms were most recently changed.

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any dispute arising from or related to these Terms or EVLV will be handled in the courts located in Ontario, Canada, unless applicable law requires otherwise.
